By accessing or using HourlyLocal.com (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, workers, employers, and others who access or use the Service.

2. Description of Service

HourlyLocal is a marketplace platform that connects hourly workers with local employers across the United States. We provide tools for workers to create verified reliability profiles and for employers to post job opportunities, broadcast shifts, and find qualified local candidates.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized use of your account
• Be solely responsible for all activities that occur under your account

4. Worker Terms

As a worker on HourlyLocal, you agree to:

• Provide truthful information about your skills, experience, and availability
• Honor shift commitments after confirming with an employer
• Maintain professional conduct with employers and other users
• Allow HourlyLocal to display your reliability score to potential employers
• Not create multiple accounts or misrepresent your identity

5. Employer Terms

As an employer on HourlyLocal, you agree to:

• Post accurate and lawful job listings with correct pay and schedule information
• Comply with all applicable federal, state, and local employment laws
• Pay workers the wages stated in your job postings in a timely manner
• Not discriminate against workers based on any protected characteristic
• Use worker contact information only for legitimate hiring purposes
• Pay all applicable subscription fees in full and on time

6. Reliability Scores

HourlyLocal calculates reliability scores based on verified shift completions, employer ratings, on-time arrival, and other performance metrics. These scores are displayed to employers to support informed hiring decisions. We strive to ensure scores are accurate but cannot guarantee their completeness. Workers may contact our support team to dispute inaccurate ratings.

7. Payment & Billing

Employer subscriptions are billed on a monthly or annual basis. All payments are processed securely through Stripe. Subscription fees are non-refundable except as required by applicable law. We reserve the right to modify our pricing with 30 days' advance notice to existing subscribers.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Post false, misleading, or fraudulent information
• Harass, threaten, or intimidate other users
• Attempt to bypass or circumvent any security measures
• Scrape, copy, or systematically extract data from the platform without permission
• Use the Service to send unsolicited commercial messages or spam
• Impersonate any person or entity

9. Intellectual Property

All content on HourlyLocal, including logos, text, graphics, software, and reliability score algorithms, is the property of HourlyLocal or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Disclaimer & Limitation of Liability

HourlyLocal is a marketplace and is not an employer. We do not employ workers listed on our platform and are not responsible for the actions of any user. The Service is provided “as is” without warranties of any kind, express or implied.

To the maximum extent permitted by law, HourlyLocal's total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other legitimate reason at our discretion. You may cancel your account at any time through your account settings or by contacting support.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
